This chapter of Title & Escrow Education Online reviews the various types of encumbrances also know as “exceptions to title” which are shown in Schedule B of the Commitment and/or Policy of Title Insurance. These exceptions are items which are either found through the title search or are items which are outside the knowledge or control of the title research process, and which may affect the title to a specific parcel of land. These items are generally established on a regional basis, based upon the law, legal standards, practices and procedures. Title and escrow professionals must have an extensive knowledge of title exceptions. This knowledge needs to include their effect on ownership, the scope of liability, and the means in which they are created. As a title or escrow officer, you will need to understand how these exceptions are created and how they are removed from title.
